Legal basis under the toll exchange is Directive (EU) 2019/520 of the European Parliament and of the Council of 19 March 2019 on the interoperability of electronic road toll systems and facilitating cross-border exchange of information on the failure to pay road fees in the Union. The directive is commonly referred to as the EETS directive (European Electronic Toll Service). The information exchange network is described in Articles 23-27.
When a failure to pay a road fee (e.g. toll for a road, bridge or tunnel) has been established, for a vehicle registered abroad, in another Member State than the Member State where the toll is levied, the EUCARIS Toll Service can be used to obtain the name and address data of the holder and owner of the vehicle. The information is used to send an information letter to the natural person or legal person responsible for paying the road fee.
A request contains a license plate number and a date and time when the road fee is levied. It is sent by the Member State that levies the toll, to the Member State of registration of the vehicle.
The toll service can be used in an online, real-time, case by case mode. It can also be used in ‘batch’ mode, i.e. in one message, multiple failure to pay road fee cases are submitted. When this mode is used, the request is queued at the Member State of registration. Usually it is processed overnight.
A Member State can use a customised client application to submit Toll requests, or it can use the EUCARIS Web Client. The EUCARIS web client supports both online, real-time mode and ‘batch’ mode.
The information exchange network should be fully operational as of October 2021. All EU Member States will take part in the exchange.
